Paying for Their Crimes, Again

Many offenders get out of jail owing hundreds or thousands of dollars in court and parole fees but face barriers to financing and job acquisition, sticking them in a punitive, vicious cycle of debt and arrest. A program called the Clapham Set, perhaps paired with conditional cash transfers - may be a solution, as it erases fees for felons who complete rehab and job training upon release.

The privatized prison system is largely skewed against inmates, as most are funded based on the number of individuals incarcerated, creating a disincentive to invest in the rehabilitation and comprehensive treatment of inmates. But the Wiri prison in Auckland is piloting a new approach that focuses on the greater good: the government pays the prison for positive results based on recidivism rates and improved outcomes for inmates, especially the Maori minority.

An in-depth study of Texas youth crime records helped them find a path forward on juvenile criminal justice reform, but they still struggle with limited resources and a culture stuck on incarceration.

Bail reform is a difficult process largely out of the hands of municipalities. Charitable bail funds allow individuals who can't afford bail to be free until their trial, in the hopes of changing the bail system from the inside.

In Texas, legislators and advocates are working to address mental health concerns for individuals entering or in the criminal justice system. For those already in jail, telepsychiatry is being offered to help rehabilitate inmates. For those just entering the system, a mental health court in Travis County has been developed to connect people with needed mental health services so that they can stand trial and even have their cases dismissed.

If incarcerated, low-income individuals who are reliant on Medicaid typically lose access to their benefits which accelerates the difficulty of reentry. To help close the gap, the National Association of Counties and the National Sheriffs’ Association have joined together to implement stopgap measures to help inmates either retain their benefits or have them only suspended instead of terminated.

The state of Mississippi has taken drastic steps in reforming their criminal justice system, pointing to a nationwide cultural shift as a driving force. State legislation, such as expanding parole eligibility, eliminating mandatory minimum sentences, and barring licensing boards from discriminating against individuals who used to be incarcerated are just a handful of policies the state has championed. The reform has led to a prison population decrease of 11% and state savings of $46 million

The Detroit Justice Center is providing a comprehensive approach to breaking the cycle of poverty in the county. The nonprofit law firm provides immediate support, like paying back child support and posting the cash bail payments that keep those experiencing poverty trapped in a cycle of debt and imprisonment. The group also aims high in their larger efforts to disrupt the criminal justice system, like suing the county to prevent the building of a new jail complex, and provides their clients and the community the chance to reimagine what the city could look like with transformative and economic justice.

In 2017, Harris County, TX saw a year where no one was sentenced to death and no one was executed. The county, nicknamed as the capital of capital punishment, is seeing a shift in the support of the death penalty. While studies haven’t shown a definitive answer, it has been linked to new, reform-focused DAs, the introduction of life sentences without parole, and Supreme Court decisions that likely diminished the use of capital punishment.

This article uses the stories of five different activist women across the United States as examples of successes using the human-centered design strategy of centering the people most directly affected in the decision-making and healing process. The women work in a variety of justice areas (from housing equity to incarceration), but they all testify to a community justice model as being the most effective and empowering solution to past and current injustices.
