America's Other Family-Separation Crisis

A digital tool called Restore Your Vote launched in the summer of 2018 to help ex-convicts understand their voting restoration status after re-integrating into society. The initiative, which has been piloted in Alabama, aims to reduce disenfranchisement in ex-convict communities by targeting unclear language, misinformation, and lack of access to education.

Millions of families of arrested individuals do not know what to do to help, how to obtain a lawyer, or what the process entails in the court system. Created by Albert Cobarrubius Justice Project, participatory defense is a type of community organizing that teaches and empowers people who face criminal charges. Individuals know how to work with attorneys in order to navigate the system and ultimately feel equipped to become drivers of their own change.

What happens when people can’t afford to pay bail? They plead guilty. That’s what happened in the Bronx Court System, which has “one of the most backlogged big-city courts in the nation.” One nonprofit, Bronx Defenders, wants to help, by paying their bail.

The Headfort Foundation runs pro bono cases for incarcerated people in need of legal representation. The Foundation recently launched a Lawyers Without Borders initiative that grants easily accessible, free legal services to those in need by setting up mobile offices. This initiative alone has helped more than 175 people thus far.

Across the United States, Black Mama’s Bail out bailed out hundreds of black women in time for Mother’s Day. The organization accepts donations to pay bail for women cannot afford it on their own as part of their larger goal of ending the cash bail system and mass incarceration. Research shows that while black women are increasingly one of the largest groups of incarcerated individuals, and yet simply posting bail has led to a majority of these cases being dropped.

Participatory defense, is a model that integrates the family into the legal defense of someone being prosecuted for a crime. Loved ones can bring in evidence like photos and records that speak to the character of the accused person. In Philadelphia, the model is being implemented and already helped reduce someone’s bail from $500,000 to $0. Nationally, the method has been proven to be highly effective. “Over 10 years, participatory defense hubs have popped up in 20 other cities and reduced people’s sentences by 4,218 years.”

Across the country, a small number of young prosecutors are changing the face of our current criminal justice system. They are moving away from the “strict law-and-order practices of the past,” and employing a more liberal approach: “eschewing the death penalty, talking rehabilitation as much as punishment, and often refusing to charge people for minor offenses.”

“Two million people with mental illness are booked into jails every year.” Mental health courts, would take into accounts a person’s illness, rather than solely focusing on the crime.

Boston-based Veterans Legal Services (VLS) is the only organization of its kind in the state. The nonprofit helps veterans access benefits and navigate civil court proceedings. Its clients are specifically low-income and homeless veterans, all of whom struggle financially.

The Defender Association of Philadelphia practices community-oriented public defense — also known as "holistic defense" — to connect clients with support services and resources that help address the root causes of crimes. The association works with social workers, investigators, and paralegals to get clients access to housing, food, jobs, and healthcare, as well as mental health and substance use treatment, with more than 150 people referred to treatment providers between September 2016 and January 2017.
