Parole gains ground as an effective prison reform in Nepal

To keep low-level crime cases out of the court process, courts in Manhattan are allowing people to take workshops on overdose intervention, social resilience, or restorative justice instead. The aim is to provide early intervention in cases that will likely be dismissed, prevent potential collateral consequences of having a charge on record, and free up staff to focus on issues like violent crime.

The Massachusetts Federal District Court’s RISE rehabilitation program facilitates a restorative justice workshop in which people responsible for crimes have conversations with victims of similar crimes to help them understand the impacts of their crimes and make amends.

The Massachusetts Federal Courthouse’s RISE rehabilitation program aims to reduce recidivism rates by hosting monthly meetings in which defendants on supervised pretrial release are encouraged to take accountability for their crimes and have conversations with people who were victims of similar crimes to understand the toll it takes on them.

Public defenders' caseloads are too large for them to be able to provide the details that a loved one of an offender can provide in court. Participatory Defense programs train loved ones of the offender to be able to provide a testimony, often resulting in less severe sentences.

Risk assessments are supposed to make the criminal justice system better by predicting which defendants are likely to commit new crimes. Defendant scores are given to judges during criminal sentencing in nine states, and there’s a push to mandate their use in federal prisons. But the risk assessments aren’t accurate, only somewhat more reliable than a coin flip. Black defendants are falsely flagged as future criminals at a high rate while white defendants regularly get mislabeled as low risk.

In some states, cash bail has been eliminated and this measure has seen significant results including lower jail populations, lower re-offense rates for people released on bonds and less jail time for those accused of low-level crimes. These results in states with bail reform laws suggest that bail reform works and serves as inspiration for other states looking to enact similar policies.

In an effort to diversify Arizona’s disproportionately white judiciary, legal professionals are volunteering in the state’s Legal Futures program to do outreach to high school and college students. The students spend face-to-face time with the professionals learning about career pathways and often leave with contact information to stay in touch.

The Bail Project is posting bond for men and women who cannot afford to pay and haven’t been convicted of a crime. Based in Detroit, the nonprofit has locations across the country and uses a revolving fund to bail out individuals, meaning once the bond is recovered, the funding is then available for another person. Its Detroit location has bailed out nearly 200 individuals in an effort to end mass incarceration and prove that holding people – most of whom are people of color or experiencing poverty – does not diminish recidivism.

In Philadelphia, the participatory defense program helps people learn how to present themselves in a criminal case in a way that gives a more complete picture of who they are. They write a biography, get letters of support and bring supporters to court in a system the chief public defender brought from Montgomery County and which originated in Silicon Valley. The program helps public defenders present their cases more effectively and judges may be more likely to impose less harsh sentences.

Although California has become the first state to eliminate the cash bail system, New Jersey has been using an algorithm for the last 18 months to combat the economic injustice created by the system. This bail reform, which looks at risk assessment on a scaled level, has successfully resulted to less people in prison as well as decreased crime rates.
